Will: Will of Samuel Merryman of Baltimore Co., dated 16 January 1754 In The name of God Amen. I Samuel Merryman of Baltimore County being of sound and perfect mind and memory but calling to mind the ? of man and knowing that it is appointed for all men now to die, do make and ordain this my last Will and Testament. Imprimis and first I commend my Soul into the Hand of Almighty God that first gave to me and my body to be decently buried at the Discretion of my Executor nothing doubting and I shall receive the Lord again at the ? resurrection and for such worldly goods as it hath pleased God to provide me with. I give and bequeath in manner and form following: Item I give and bequeath to me eldest son Samuel Merryman all that land or parcell of land called Drunkrids Hall to him and his Heirs forever and also three Negroes Liz, Jacob and Judith to him and his Heirs forever and also one feather bed and furniture, Three Silver spoons & one Silver Cup and to have no more of my personal Estate. Item I give and bequeath to my daughter Rebecca Price one Negro boy named Loney to her and her Heirs for ever and I give no more of my personal Estate. Item I give and bequeath to my daughter Katurah Parish one negro boy named Davy to her and her Heirs for ever and to have no more of my personal Estate. Item I give and bequeath to my son Nicholas Merryman all that Land or Parcell of Land called Merrymans Pasture to him and his Heirs for ever and also all my personal Estate after my just debts are paid to him and his Heirs forever of this my last Will and Testament. In Testimony where of I have hereunto ? set my hand and affixed my seal this sixteenth day of January in the year of our lord Seventeen Hundred and fifty four. March 23 1754 Benj~ Brown one of the Subscribing Witnesses to the forgoing Will made his solemn affirmation that he saw the Testator Sam Merryman sign the forgoing Will at the same time ?? & Wm Oliver the other two subscribing witness being duly and solemnly sworn on the Holy Evangelist of Almighty God dispose & say that they saw the Testator Samuel Merryman sign the foregoing Will and heard him publish and the same to be his last Will and Testament. That at the time of his so doing he was to the best of their apprehensions of a Sound and Disposing mind & memory & that they Subscribed their subscribers names as Witnesses to the Will in presence of the Testator and at his request. Will: Last Will & Testament of Charles Merryman of Baltimore Co., dated 16 Jan 1724 Probated 14 Jan 1725 -------------------------------------------------------------------------------- In the Name of God Amen. The sixteenth day of January one Thousand seven Hundred and Twenty four. I Charles Marryman of Baltimore County & Province of Maryland planter being of perfect mind and memory thanks be given unto God for & calling to mind the mortality of my body and knowing that it is appointed for man once to die, Do make and ordain this my last will and Testament in manner and form following, that is to say first and principally I give my soul into the hands of God who gave it to me and for my body I command it to the Earth to be buried in Christian and decent manner nothing doubting but altho general I ? I shall receive the same again by the mighty power of God and as touching my worldly Estate is herewith it hath pleased God to bless me in this life I give, devise and I signeth and dispose the same in manner and form following. Item: I do hereby nominate, constitute and appoint my true and beloved wife Mary Marryman to be my whole and sole Executrix to see all my lawful and just debts be paid. Item: I give and I bequeath my dwelling plantation with the land and woods thereunto belonging jointly and equally between my wife Mary Marryman and my daughter Elizabeth Cox jointly and equally to be enjoyed by the said parties during the natural life of my said wife and at her decease ?/ to my daughter Elizabeth Cox and the heirs of her body lawfully begotten for ever. Item: I give and bequeath unto my said Executrix all and singular my personal Estate remaining after my just debts are paid and do hereby Impower her my said Executrix ? to will I bequeath, devise and dispose the same as she shall think fit peaceably and give authority to enjoy or dispose of the same without any manner of lott hindrance or molestation from any person or persons whatsoever. Item: I give and bequeath unto my grandson Marryman Cox one hundred acres of land beginning at the Tanners Run and running up the said run with my outward line till it comes to one Hundred acres. Item I give and bequeath unto my Eldest son John Marryman one piece of money to the value of one shilling Sterling. Item I give and bequeath to my youngest son Samuel Marryman one piece of money to the value of one shilling sterling. And I do hereby utterly disallow revoke and annull all and every other former Testament, Wills, ? , Requests and Executors by me in any wise before this time namely Wills I bequeathed, ratifying and confirming this and none other to be my last Will and Testament. He married 1st, Mary Haile, the daughter of Nicholas and Mary Haile & the widow of Henry King. Mary is the mother of his three sons, the eldest two sons were apparently born in Lancaster Co. VA. Charles Merryman married second, by 1693, Mary, the adminstrix of the estate of Andrew Matson. It appears his daughter Elizabeth who married Jacob Cox was by his second wife, based on the above will and her apparent age.

Note: There were several early HAILE, HALE, HAYLE, HEALE settlers in Virginia. Some have claimed that Nicholas Haile was the son of a George Haile. This is questionable, since while there were some George Hale immigrants, notably a 13 year old drummer boy named George Hale on the ship Supply in 1620, an a George Hale/Heale in Northumberland County who claims to be over 60 years of age in 1661, it seems that records indicate that Nicholas Haile of Lancaster Co VA, was of York County until 1656 when he is described as of Lancaster Co. In the Records of Northumberland Co is a Thomas Haile,Hayles, Hale who seems to have been born ca. 1601, and may be the 20 year old Thomas Hale arriving on the GEORGE in 1623. The Thomas Haile appears in Northumberland Co records starting in 1648. He apparently had a son name John. What relation may exist between Nicholas Haile and these other Haile, Hale families that were living in the same area is unknown. There have been claims that Nicholas' wife Mary was nee Travers, however, so far there does not appear any substaniation of this claim and it appears that in migh have arose from a missinterpretation of Mary Hale being listed in the debts of the estate of Rawleigh Travers.
